NAFR HIGH COURT OF CHHATTISGARH, BILASPUR CR.R. No. 583 of 2017 Sunil Kumar Navrang, S/o. Sahukar Navrang, aged about 35 years, R/o. Village-Goinda, P.S. - Pathariya, District - Mungeli (C.G.). ---- Applicant

Versus

Smt. Rajeshwari Navrang, S/o. Sunil Kumar Navrang, aged about 33 years, R/o. Village-Sakari, P.S. Chakarbhatha, District - Bilaspur (C.G.) ---- Respondent For Applicant : Mr. Praveen Dhurandhar, Advocate Hon'ble Shri Justice Goutam Bhaduri Order On Board 19/06/2017 1.

This revision is against the order dated 13.04.2017, passed in M.J.C. Case No.140/2017, passed by learned Additional Principal Judge, Family Court - Bilaspur, District - Bilaspur (C.G.), wherein interim maintenance of Rs.3,000/- has been awarded to the respondent.

2.

Learned counsel for the applicant would submit that the relation enter-se between the parties has not been established and only on the basis of the agreement, non-applicant has been held to be wife, whereas, she is not the wife of the present applicant. 3.

The issue which has been raised by the applicant in this petition can only be adjudicated after respective parties adduced their evidence on merits and only by simply reading it can not be accepted and

held that the applicant and the respondent do not have any relation of husband and wife.

4.

Considering the quantum of the interim maintenance of Rs.3000/-, and taking into the fact and further after going through the order, in my considered opinion no jurisdictional error has been committed or it can be stated that it is a case where the Court has exceeded the jurisdiction vested in it by law. Therefore, considering the same I am not inclined to interfere with such finding to disturb the interim maintenance granted to the respondent.

5.

Accordingly, the revision petition has no merit and is dismissed at admission stage itself. However, the Family Court is requested to expedite the trial. H Sd/- (Goutam Bhaduri) Judge Balram
