1. The applicant has preferred this second bail application under Section 439 of Cr.P.C. as he is in jail since 01.11.2020 in connection with Crime No. 486/2020 registered in Police Station Arang, District - Raipur (C.G.), for the offence punishable under Sections 376, 323 of IPC.

2. The first bail application of the applicant was dismissed on merits vide order dated 01.07.2021 passed in M.Cr.C. No. 1268/2021.

3. Learned counsel for the applicant seeks to withdraw this second bail application with liberty to file a fresh application as and when occasion arises.

4. Accordingly, the second bail application is dismissed as withdrawn with the liberty as stated above.
