Sam Koshy Order On Board 16/12/20 This is the first bail application filed u/s 439 of Cr.P.C. for grant of bail to the applicant who is in jail since 04.11.2020 in connection with Crime No. 376/2020 registered at Police Station- Mandir Hassaud, District Raipur (CG) for the offence punishable under Sections 302 read with Section 149, 201 read with Section 149, 435 read with Section 149 of IPC.

The allegation against the applicant as per the prosecution case is that the applicant in connivance with other accused persons is said to have assaulted deceased Kishan Gilhare on the date of incident i.e. on 03.11.2020 on account of which Kishan Gilhare died. Subsequently, it is said that the present applicant had brought petrol which was poured upon the body of Kishan Gilhare and he was burned. It is also alleged that the petrol was used for burning the two wheeler of the deceased.

The further case of the prosecution is that the mobile phone belonging to the deceased was also recovered from the possession of the present applicant.

Taking into consideration the entire facts and circumstances of the case particularly the gravity of offence and the period of custody undergone by the applicant, this Court is of the opinion that it is not a fit case for grant of bail to the applicant at this juncture. 4.
