The applicant has preferred this application under Section 439 of Cr.P.C. as he is in jail since 17.08.2020 in connection with Crime No. 154/2020 registered at Police Station - Somani, District Rajnandgaon (C.G.), for the offence punishable under Section 376 of Indian Penal Code.

2. Learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

liberty as stated above.
