1. Heard.

2. It is submitted on behalf of the petitioner that the petitioner was an employee of the Adim Jati Seva Sahkari Samiti Maryadit Kharsiya Distt. Raigarh (C.G.). The petitioner was terminated from his services on 27.08.1993. The petitioner moved an application under Section 55(2) of the M.P. Co-operative Societies Act 1960 before the respondent praying for setting aside his termination order. The case was registered as No.1/1994 but the case was kept pending for the reason that the criminal prosecution against the petitioner was pending. In the later on development, the trial in the criminal case against the petitioner has been concluded and the petitioner has been acquitted in the same. The petitioner moved an application vide Annexure P/3 on 02.12.2019 praying for decision on his application under Section 55(2) of the Act 1960 but the same is not being considered by the respondent, therefore it is prayed that an appropriate direction be passed.

3. Learned State counsel representing the respondent opposes the submission

and submits that an appropriate order be passed.

4. After considering on the submissions made by the petitioner, the application filed by the petitioner for reinstatement in his services was kept pending only for the reason that the criminal trial against the petitioner was pending and now as it is informed that the trial in the criminal case is concluded and the petitioner has been acquitted. Hence the application filed by the petitioner needs to be decided at the earliest.

5. Hence this petition is disposed off at the motion stage. The respondent is directed to consider and take the decision on the application filed by the petitioner under Section 55(2) of the Act 1960 at the earliest preferably within a period of 60 days from today.
