1. The applicant has preferred this bail application under Section 438 Cr.P.C, as he is apprehending his arrest in connection with Crime No. 52/2017, registered at Police Station Prem Nagar, District Surajpur C.G. for the offfence punishable under Section 420/34 of the IPC.
2. Learned counsel for the petitioner would submit that since petitioner has been arrested during pendency of the anticipatory bail application, the same is rendered infructuous.
