Heard.
Perusal of the case would show that on a certain report which was made on 31/08/2015 the Police has registered the case
under Section 294, 506 B, 323, 456/34 of the Indian Penal Code.
Counsel for the petitioners would submit that the dacoity was also committed and evidence is not being recorded and there was an effort of the accused to kill the petitioners and also outraged the modesty of the petitioner No. 2, therefore, the Police may be directed to register the case under the charging section as alleged.
Perusal of the case file would show that the report was made on 31/08/2015 and it seems the matter is being investigated. It is expected that the State authorities / the Police shall record the statement of the witnesses and the victim, as it is narrated without making any intervention of their own and if the petitioners are still aggrieved, they shall have the remedy to file the necessary complaint, if so advised. Hence this petition is premature.
