1. The limited grievance that petitioner has in the present writ petition is for non granting of the benefits of 7th pay commission to the petitioner.

2. Perusal of the record show that there does not seem to be any order or decision of the respondents whereby the entitlement of the petitioner is doubted. It appears for some administrative reason the same could not be implemented by now.

3. Given aforesaid facts and circumstances of the case, let respondent No. 2 to 5 to take all necessary steps ensuring that petitioner is granted benefits of 7th pay commission from the date it has been implemented to all other similarly placed persons along with arrears that the petitioner would be entitled for.

4. Let a decision be taken within a period of 90 days from the date of receipt of copy of this order.

5. It is made clear, in case, if it is found that petitioner is entitled for those benefits and if the petitioner is not paid within the stipulated period the petitioner shall also be entitled for interest on the said amount at the rate of 10% per annum from the date it fell due till the date actual payment is made. The said interest would be recovered by the State Government from the erring officer who did not promptly process the case of the petitioner, unless the delay could be attributed for fault of the petitioner.
