This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.145/2015 registered at Police Station- Pandari, District Raipur (C.G.) for the offence punishable under Section 420, 467, 468, 471, 120-B of I.P.C.

As per the prosecution case, the applicant in connivance with other co-accused were running Shreya Job Placement Agency and received certain amounts from different unemployed persons and gave them forged appointment letters and subsequently the appointment letter was found to be fake and certain cheques which were given as return of amount were bounced. 3.

Learned counsel for the applicant submits that the applicant is in jail since 13.06.2015 and on that ground the other co-accused namely Smt. Tara @ Soniya has already been enlarged on bail by this Court on 25.06.2018 in MCRC No.3285 of 2018 and the case

of the present applicant is similar to that of the other co-accused, therefore, she may also be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail, however, he do not dispute the fact that the similarly placed co-accused has already been released on bail. 5.

Considering the fact that the applicant is in jail since 13.06.2015 and the similarly placed other co-accused has already been released on bail on 25.06.2018 in MCRC No.3285 of 2018, I am inclined to release the present applicant on bail. 6.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the concerned trial Court, for her appearance as and when directed. Sd/- (Goutam Bhaduri) Judge Ashok
