This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 169/2015, registered at Police Station Chakrabhata, Civil and Revenue District Bilaspur (C.G.), for the offence punishable under Sections 379, 457, 34 of the I.P.C. 2.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence; the manner, in which, applicant is said to have committed theft and stolen various silver and gold articles worth Rs.1,00,000/- from the house of Pradeep Upadhyay; subsequent recovery from his possession and previous criminal antecedent of the applicant, this Court is not inclined to release the applicant on regular

bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
