1. At the outset, learned counsel for the applicant submits that he may be permitted to withdraw instant MCRC with liberty to file repeat application for his release on bail before the Court of Sessions, Korba (CG) as the order of rejection of bail petition filed by the applicant by the sessions court was prior to the filing of the charge sheet.

2. As prayed, instant MCRC is disposed of as withdrawn without appreciation on its merit reserving the aforesaid liberty if available under the law.
