The applicant has preferred this application under Section 439 of Cr.P.C. as he is in jail since 26.11.2020 in connection with Crime No. 522/2020 registered at Police Station - Kotwali, jagdalpur, DistrictBastar (C.G.), for the offence punishable under Section 384 of Indian Penal Code & Section 4 of The Protection of Debtors Act, 1937. 2.

At the very outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

Accordingly, the application is disposed of as withdrawn with the

liberty as stated above.
