Considering the finding of fact arrived at by the Court below at paragraph-32 of the impugned judgment, this Court is of the opinion that arguable points have been made out by the counsel for the petitioner seeking for interference with the impugned judgment.

Accordingly, the application seeking leave to appeal is allowed. Leave as prayed for is granted.

Let this Cr.M.P now be registered as Acquittal Appeal and the matter be listed immediately thereafter for admission.
