Sam Koshy Order On Board 12/09/201 This is the third bail application filed u/s 439 of Cr.P.C. for grant of bail to the applicant who is in jail since 12.06.2017 in connection with Crime No. 149/2017 registered at Police Station- Gurur, District Balod (CG) for the offence punishable under Sections 420, 467, 468, 471, 120B/419 of IPC and 66(?k) of IT Act.

The present is a third bail application. The earlier bail application stood rejected on 06.08.2018 by this Court considering the facts and circumstances as it then prevailed. Barely one month's from the date of previous rejection order, the present application has been filed and the applicant seems to bank upon the statement made by the complainant who was examined on 12.07.2018. The statement of the said complainant was already recorded when this Court had rejected the bail
application on previous date i.e. on 06.08.2018. Thereafter, there does not appear to be any substantial development calling for reconsideration of the rejection of the bail application dated 06.08.2018. Moreover, it appears that all the material witnesses have already been examined. All those witnesses who are left to be examined, the trial Court is directed to exercise all the powers conferred upon it under the provisions of CrPC so far as taking steps for calling of the witnesses and thereafter ensure that the trial is concluded at the earliest.

With the aforesaid observation, the present bail application stands rejected.
