1. When the matter is called for hearing, none present for the applicant. No representation is made.

2. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.270/2015, registered at Police Station Arang, Distt. Raipur, for the offence punishable under Section 34 (2) of the Chhattisgarh Excise Act, 1915.

3. Taking into consideration the nature and gravity of offence, facts and circumstances of the case, quantity of liquor seized from the applicant i.e. 12.600 bulk litres, the provisions contained in Section 59-A (ii) of the Chhattisgarh Excise Act, 1915 and looking to the fact that two previous criminal cases have been registered and are pending against the applicant, I am not inclined to grant regular bail to the applicant. Consequently, the application is rejected.
