The present petition has been filed under Section 378 (3) of the Cr.P.C., seeking leave to appeal.

Considering the facts and circumstances of the case, leave as prayed for by the petitioner is granted.

Let this CRMP be registered as Acquittal Appeal. The appeal is admitted.

After registration of regular appeal, issue fresh notice to respondents 2 to 5 on payment of process fee as per rules making the same returnable within five weeks. List this case after five weeks.

In the meanwhile, learned counsel for the State to ascertain as to whether State wants to file any Acquittal Appeal or not.

On the next date, affidavit of responsible officer shall also be filed on behalf of the State.
