NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR WPS No. 5920 of 2018 V.S.Vargeesh S/o Late Shri Simon George, aged about 50 years, posted as Sanitary Inspector, C.S.E.B. (civil construction division) CSPTCL, Bhilai-3, District Durg (C.G.).
---Petitioner
Versus
1. Chhattisgarh State Power Holding Company Ltd., Through : It's C.M.D. Dagania Raipur, District Raipur (C.G.).
2. General Manager (HR), C.S. Power Holding Company Ltd., Dagania Raipur, District Raipur (C.G.).
3. Dy.General Manager (HR) II, C.S. Power Holding Company Ltd., - Dagania Raipur, District Raipur (C.G.).
---Respondents For petitioner :
Shri Ravish Verma, Advocate.
Hon'ble Shri Justice P. Sam Koshy Order on Board 10/09/2018 1.
The prayer made by the petitioner in the instant Writ Petition is for issuance of direction to the respondents to give an opportunity to the petitioner to participate in the recruitment process initiated in the advertisement published on 18/07/2018 for the post of Accounts "
Officer/Assistant Manager (FA) Trainee ."
2.
The contention of the counsel for the petitioner is that, while in service, the petitioner has been able to obtain the qualification of ICWA which is also a suitable qualification for the post of Accounts Officer. However, the respondents while publishing the advertisement have not incorporated the said qualification and thus prayed for modification in the qualification part.
3.
Perusal of record would show that, it is an advertisement Annexure- - P/1 which has been published for filling up the post by way of direct recruitment. That in the said advertisement, the age limit also has been specifically prescribed.
4.
The petitioner in the instant Writ Petition is aged about 50 years. 5.
Under the circumstances, the petitioner in any case would not get the benefit of participating in the recruitment process even if the qualification part is diluted.
6.
Now, coming to the question of promotion, the post on which the petitioner is presently holding is not the feeder post for the post of Accounts Officer or in other words the next promotional post from the post on which the petitioner is working is also not that of Accounts Officer. 7.
In the given facts, this Court is not inclined to interfere with the advertisement published Annexure-P/1.
8.
Reserving the right of the petitioner to ventilate his grievance by moving a suitable representation to the employer where he is working, the present Writ Petition in its present form stands dismissed. Sd/- (P. Sam Koshy) Sumit JUDGE
