The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.279/2015 registered in Police Station Jamul, Dist. Durg (C.G.) for offence punishable under sections 341, 394, 294, 506 & 323 of Indian Penal Code. 2.

As per the prosecution case, on 8/06/2015 present applicant alongwith other co-accused impersonating themselves as police officers robbed Rs.7,500/- from the complainant Rajesh Singh and thereby committed aforesaid offence.

Learned counsel for the applicant submits that Rajesh Singh has been examined, he has not attributed any allegation against this applicant and applicant has been falsely implicated in the case, therefore he may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Alongwith statement of Rajesh Singh other statement of Muktiyar Singh and Onkar Rai, their statement is also on record and they are witness to the identification, therefore entire statement cannot be

evaluated just like trial while consideration of the bail application. Considering the fact that out of 20 witnesses, 5 witnesses have already been examined and also considering the fact that bail of the similarly placed co-accused has been dismissed by the coordinate bench of this court in M.Cr.C. No.4871/2015 on 21/09/2015, this court is not inclined to release the applicant on bail.

Accordingly, the bail application is dismissed. Certified copy as per rules.
