The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.253/2016 registered in Police Station Bemetara, District Bemetara (C.G.) for offence punishable under sections 354, 323 of Indian Penal Code and Section 08 of Protection of Children from Sexual Offences Act, 2012.

As per the prosecution case, on 19/05/2016 the victim/girl was waiting in the lane, at that time the applicant came there, caught hold of her hand and placed his hand on the breast of the girl and thereafter kissed the girl, therefore tried to outrage modesty of the girl. Thereby, offence is committed.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case and it is a case of simple quarrel between the prosecutrix and the applicant and it has been exaggerated to the extent and false allegations have been levelled, charge sheet has been filed, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail.

Perused the statement of the victim. Considering the facts and circumstances of the case, degree of allegations levelled, charge sheet has been filed, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
