(2) This is the second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested on 30.10.2014 in connection with Crime No.502/2014 registered at Police Station Bhilai Nagar, Durg, District Durg, for the offence punishable under Sections 363, 366, 376 of the Indian Penal Code.
(3) The applicant's first bail application was dismissed as withdrawn with liberty to file the same after examination of all the material
prosecution witnesses by order of this Court dated 19.02.2015 passed in M.Cr.C. No.719/2015.
(4) This second bail application has been filed without examination of all the material prosecution witnesses except two Doctors, as such, the second bail application cannot be entertained in view of the order dated 19.02.2015.
(5) The applicant is free to file bail application after examination of all the material prosecution witnesses as prayed earlier. (6) The second bail application as framed and filed is dismissed reserving liberty in favour of the applicant. (7) Certified copy as per rules.
