This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.57/2015, registered at Police Station-Bhilai Bhatti, District-Durg (C.G.), for the offence punishable under Sections 354 & 376 of the IPC and Section 4 of the POSCO Act, 2012. 2.
I have heard learned counsel appearing for the parties and taking into consideration the facts & circumstances of the case, nature & gravity of the offence, the matter in which the applicant is said to have committed forceful sexual intercourse with her minor daughter aged about 6 years and evidence available on record, this Court is of the opinion that present is not a fit case, in which, the applicant should be enlarged on regular bail. 3.
Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected.
