NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Criminal Revision No. 846 of 2015 Dhananjay Sarthi, son of Shri Patangram Sarthi, aged about 38 years, working as Assistant Principal, High School Halahuli, Tahsil Kharsiya, District Raigarh (CG.) ---- Applicant

Versus

Smt. Sangeeta Sarthi, wife of Shri Dhananjay Sarthi, aged about 33 years, resident of New Mandi Road, in front of Central Ware House, Fafadih Shastri Nagar, Raipur. ---- Non-applicant For Applicant :

Shri C. Jayant K. Rao, Advocate.

Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 07/10/2015 (1) Heard on admission.

(2) In an application under Section 127 of the Code of Criminal Procedure (for short 'the Cr.P.C.') filed by applicant namely Smt. Sangeeta Sarthi, the learned Family Court, Raipur, by its impugned order dated 12.08.2015, passed in M.J.C. No.33/09 has enhanced allowance for maintenance from Rs.1000/- to Rs.3,500/- per month. (3) Learned counsel appearing for the applicant submits that the enhancement made is shockingly high and there is no basis to make such an enhancement.

(4) Taking into consideration the facts and circumstances of the case and further taking into consideration the cost of living, standard of living, price-index and the basic needs of the non-applicant/wife,

enhanced monthly allowance for maintenance from Rs.1000/- to Rs.3500/- and further considering the fact that the applicant is working as Assistant Principal in Government School and having sufficient means to make payment of it, I do not find any illegality in the impugned order warranting interference by this Court in its revisional jurisdiction.

(5) The revision deserves to be and is accordingly dismissed at admission stage without notice to other side. Sd/- (Sanjay K. Agrawal) Judge L/-
