This is third bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 27-01-2017 in connection with Crime No.2/2017 registered at Police Station - Amabeda, District North Bastar Kanker, Chhattisgarh for the offence under Section 302 of the IPC and Section 27 of Arms Act.

This third application has been filed by the applicant for grant of regular bail only on the ground of delay submitting that the applicant has undergone four years in jail. The first bail application of this applicant, MCRC No.3263 of 2017 was dismissed on merits on 23-11-2017 and his second application for bail, MCRC No. 588 of 2018 was dismissed as withdrawn on 29-01-2018. 3.

After hearing the submission, I am of this view that there is no new ground present to entertain this present application and the ground of delay cannot be the only ground for releasing any accused on bail Therefore, this application is dismissed at motion stage.
