The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.84/2015 registered in Police Station Gidhouri, District-Balodabazar-Bhatapara (C.G.) (wrongly mentioned as P.S.-Bilaigarh in the rejection order) for offence punishable under sections 379, 407, 420, 120 (B) of IPC and 3/7 of Essential Commodities Act.

As per the prosecution case, certain paddy were transported from Nardha to Baktara, Mandir Hasoud. The applicant who was driver of the truck after collection of the paddy got the number plate of the truck changed to CG 04 JC 5871 instead of CG 04 JC 5170 and sold the paddy to one Garg Rice Mill which was worth Rs.3,26,400/-. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, he was only a driver, charge sheet in this case has been filed, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail and would submit that apart from this case, 2 cases are registered against the

applicant one bearing Crime No.150/2015 registered at PS Bilaigarh and another case bearing Crime No.149/2015 registered at PS Bilaigarh wherein in the similar way the offence has been committed by the applicant by changing the number plate.

Perused the case diary and the documents. Considering the facts and circumstances of the case and also for the fact that similar nature of offence has been committed by the applicant, this court is not inclined to release the applicant on bail.
