This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.10/2014, registered at Police Station Pharasgaon District Kondagaon (Chhattisgarh), for the offence punishable under Section 25 of Arms Act, R/w 16(i) b, 17, 18, 19, 40 of Unlawful Activities (Prevention) (Amended) Act,2004. 2.

Learned counsel for the applicant submits that the prosecution witnesses have already been examined.

On the other hand, learned counsel for the State/non-applicant submits that the Special Court NIA, Jagdalpur has already been constituted. 4.

At this stage, learned counsel for the applicant seeks to withdraw

this bail application with a prayer to direct the Special Court to expedite the trial.

Prayer appears to be fair and reasonable.

Accordingly, bail application is dismissed as withdrawn. However, concerned Special Court is directed to expedite the trial and decide the case as early as possible within a period of two months. 7.
