For Non-Applicant : Smt. Astha Shukla, Panel Lawyer. Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 11/10/2018 :

1. The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.4/2018, registered in Police Station Borai, District Dhamtari for offence under Section 20(B)(ii)(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

2. The applicants along with co-accused Manik Khara were found to possess contraband Ganja weighing about 15 kg, out of which 5 kg each has been recovered from the present applicants.

3. While dismissing the first bail application, liberty was reserved to move again at an appropriate stage. Vide MCRC No.5719/2018, coaccused Manik Khara has already been released on bail. These applicants are in jail since 23.1.2018.

4. In the circumstances, this Court is inclined to release the applicants on

bail.

5. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.1 lakh with 2 local sureties of Rs.50,000/- each to the satisfaction of the trial Court.
