This is first bail application filed u/s 439 of the Code of Criminal Procedure for grant of bail to the applicant in connection of crime No. 43/2017 registered at P.S.- Narayanpur, District- Jashpur for the offences punishable under sections 363, 370, 371, 374 of IPC.

As per the prosecution case, the petitioner along with other accused Pradeep Malar and Lokesh Shandilya allured the victim Satyam Ram who is aged about 16 years and thereafter, on the pretext of providing employment, the petitioner brought the victim from Kunkuri to Kansabel and handed over him to one Pradeep Mallar at Kansabel. Pradeep Mallar took the victim further to Tamilnadu and forced him to work in a bore-well Company of one Kumar Mangalam and after receiving Rs. 8000/- per child from Kumar Manglam, Pradeep Mallar fled away. Subsequently, on a report being made by complainant Sushila Bai, mother of Satyam Ram, the matter was being

investigated and Satyam Ram was recovered from Tamilnadu. Learned counsel for the appellant submits that the applicant has not committed any offence and he has only escorted the victim from Kunkuri to Kansabel and he had not been to Tamilnadu, therefore, no allegation is attributed to this applicant.

Per contra learned State counsel opposes the bail application.

Considering the facts and circumstances of the case and the nature of evidence available, at the stage, I am not inclined to allow this bail application. Accordingly, it is rejected. Sd/- GOUTAM BHADURI JUDGE R a o
