1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 17/2017, registered at Police Station- Gol Bazar, District - Raipur (C.G.) for the offence punishable under Section 420, 468 and 471 of Indian Penal Code (for short 'IPC').

2. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in this case. As alleged, applicant had produced a certificate in job interview that was found to be fake on verification. As the applicant was not benefited with any appointment, hence, no offence of cheating etc. is committed in this case. It is also submitted that in similar cases, other accused persons have been benefited with grant of bail. The case of applicant is not different in any

Page No.2 manner, hence, prayed that applicant be enlarged on bail.

3. Learned State counsel opposes the bail application and submissions made in this respect.

4. Heard both the parties and perused the case diary.

5. On line applications were called for direct recruitment to the post of Librarian by Chief Executive Officer of Zila Panchayat, Raipur. Applicant submitted his application along with mark-sheet of B.Lib and I.Sic purporting to be issued by GGUI. The same was verified and found to be a fake and forged certificate, which is the basis of the case against the applicant.

6. Considering the totality and circumstances of this case and fact, that similar cases have been registered against various other candidates for having produced fake/forged mark-sheets, they have been benefited with grant of bail by this Court, hence, this application also deserves to be allowed.

7. Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed.
