(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing her on regular bail during trial in connection with Crime No.418/2015 registered at Police Station - Balod, District- Balod for the offence punishable under Section 34 (2) of the Chhattisgarh Excise Act.

(2) After hearing learned counsel for the parties and taking into consideration the facts & circumstances of the case and in view of the provisions contained in Section 59-A(ii) of the C.G. Excise Act, 1915 and the fact that the applicant is involved in criminal case being Criminal Case No.871/2015 in the Court Chief

Judicial Magistrate, Balod, I am not inclined to release the applicant on bail. Thus, the bail application is rejected. However, the applicant is free to repeat the bail application after disposal of that criminal case.
