This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.32/2015 registered at Police Station Ambikapur, District Surguja (C.G.) for the offence punishable under Section 420 of Indian Penal Code. 2.

As per the prosecution case, a report was made by the complainants Rajkumar, Ramkishun & Pradeep Kumar that the applicant in order to provide job was obtained an amount of Rs.2,90,000/- from them for which a report was made initially to the Collector. Subsequently, after investigation the applicant was arrested and the charge sheet was filed.

Learned counsel for the applicant would submit that the applicant has been falsely implicated and no evidence is available that the complainants have paid the amount to the applicant, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the statement of the complainants and the witnesses Amar Singh, Rambharos & Mansay. Considering such statements and the way the offence has been committed to provide job to the complainants, I am not inclined to release the applicant on bail. 6.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
