The limited grievance which the petitioner has raised in this petition is for a direction to the respondents to take a decision on the representation of the petitioner for grant of benefit of wages and other allowances which the petitioner would have got during the period of suspension from 20.08.2007 to 19.05.2010 on account of fact that criminal case which was registered against the petitioner initially was decided in his favour by an order of acquittal dated 01.05.2018 decided by the court of Judicial Magistrate First Class, Akaltara, Distt. Janjgir Champa.

The said prayer is not opposed.

Accordingly, it is directed that the respondents No.2&3 both shall consider the case of the petitioner and pass a suitable order as to how the period of suspension has to be treated taking into consideration the provisions of the Fundamental Rules in this regard and would also decide as to what would be the entitlement of the petitioner.
