This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.62/2017 registered at Police Station- Bodla, District Kabirdham (C.G.) for the offence punishable under Section 306, 498-A of I.P.C. 2.

As per the prosecution case, one Santoshi Jaiswal alongwith her three months child committed suicide by setting herself ablaze for the reason that the applicant who is husband used to torture her for demand of money to purchase Bolero vehicle and further was abused for the reason that she has given birth to girls only. 3.

Learned counsel for the applicant submits that after 9 years of marriage, the incident happened and there is no abetment has been caused, therefore, the applicant may be released on bail. 4.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the statement of father of the deceased Govind Jaiswal, mother of the deceased Smt. Pinki and sister Ku. Sukritika Jaiswal. Considering the same, I am not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
