Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 0 7 /0 4 /201 (1) By the impugned order, the Revisional Court has allowed the revision filed by the respondent, therefore, at the instance of present applicant, revision under Section 397/401 of the Code of Civil Procedure would lie and, therefore, the present Cr.M.P. as framed and filed is not maintainable.

(2) Accordingly, the Cr.M.P. is dismissed as not maintainable. However, the petitioner is at liberty to file revision under Section 397/401 of the Code of Civil Procedure.
