Hon'ble Shri Justice P. Sam Koshy Order on Board 10.10.2018

1. The challenge in this petition is to the order dated 05.06.2018 passed by the Collector, Bilaspur, whereby the appeal preferred by the petitioner challenging the appointment of the respondent No.6 was rejected.

2. This court at the first instance itself is not inclined to entertain this petition for the reason that there is a remedy of filing revision available for the petitioner to assail the order passed by the Collector which is impugned in the present writ petition.

3. This court all the more is not inclined to entertain this petition for the reason that on an earlier occasion the petitioner had preferred a writ petition WPS No.6160 of 2011 and this court refused to entertain the same on 11.07.2017 reserving the right of the petitioner to exercise the remedy of appeal. The petitioner having availed the said remedy of appeal

has now to exercise further remedy of revision also available to the petitioner assailing the order of the Collector.

4. Accordingly, reserving the right of the petitioner to prefer a revision against the order of the Collector within a period of 15 days from today, the present petition stands disposed of. In the event if the petitioner prefers revision, it is expected that the revisional authority shall thereafter decide the revision within a further period of 90 days from the date of filing of revision.
