This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.133/2014, registered at Police Station Pasan District Korba, C.G., for the offence punishable under Section 376 of the Indian Penal Code.

After hearing learned counsel appearing for the parties and taking into consideration the nature and gravity of offence; statement of prosecutrix and the fact that trial is on advanced stage, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected. However, trial Court is directed to expedite the trial and decide the case as early as possible preferably within a period of six months from the date of receipt and/or production of certified copy of this order. 4.
