This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.31 of 2016 registered at Police Station Saja, District Bemetara (C.G.) for the offence punishable under Section 20-B, 2(B) of N.D.P.S. Act. 2.

As per the prosecution case, on a raid being conducted on 03.02.2016 from the possession of the applicant, 1350 grams of Cannabis were recovered.

Learned counsel for the applicant would submit that the charge sheet in this case has been filed and no further investigation is necessary, therefore, the applicant may be released on bail. 4.

Per contra, learned State counsel opposes the prayer for grant of bail and would submit that Crime No.48/2012 was registered against the present applicant for keeping the Cannabis in the like nature and four other cases under the Cr.P.C. were registered against the applicant, therefore, he is not entitled to be released on bail.

Learned counsel for the applicant on being asked about the facts, he was not able to make any submission that what happened to the earlier cases, which has been registered against him. 6.

Considering the facts and circumstances of the case and the fact that earlier also the similar nature of offence has been registered against the applicant, I am not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
