This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No.150 of 2015, registered at Police Station Palari, District-Balodabazar-Bhatapara (C.G.) for offence punishable under Section 186 & 353 of IPC. 2.
As per the prosecution case, complainant Vinod Kumar Dahariya lodged FIR who is Assistant Engineer in Electricity Department that on 15/05/2015 at about 9.30 when the electricity was off, applicant who disclosed his identity as journalist of Hari Bhumi entered into the office and abused officer and assaulted by hands and fist whereby he sustained injuries. Thereafter, on report being made, matter is being investigated. 3.
Learned counsel for the applicant submits that applicant has not over acted and 200-300 persons were present in the spot i.e electricity
office when the electricity connection was off and the applicant being journalist was present in the spot to cover incident, therefore applicant may be enlarged on anticipatory bail.

Learned State counsel opposes the prayer for grant of bail and submits that applicant himself entered in the office and assaulted the complainant which is supported by MLC.

Considering the nature of offence and evidence available till date and as the applicant has been named specifically in commission of crime, I am not inclined to extend benefit of anticipatory bail to the applicant. 6.
