I.A. No.1 This is an application for condonation of delay in filing the

2 CRMP No. 742 of 2017 Cr.M.P.

On due consideration, delay of 60 days in filing the Cr.M.P. is allowed.

1. Heard on prayer for grant of leave to appeal.

2. Trial Court has acquitted the accused from the charges under Section 304B of I.P.C. on finding contradiction and discrepancies in the deposition and statements under Section 161 Cr.P.C., of parents of the deceased.

3. We have perused the deposition and their statement under Section 161 Cr.P.C. On close scrutiny, we are satisfied that the State's prayer for granting leave to appeal deserves to be allowed.

4. Accordingly, the present CRMP is allowed.

5. Let the regular acquittal appeal be registered and it be listed in the week commencing 24th June, 2019.
