For the reasons stated in the application, the same is allowed. Delay in filing the instant petition is condoned. The present petition has been filed under Section 378(1) of the Cr.P.C., seeking leave to appeal.

Considering the facts and circumstances of the case, leave as prayed for by the State is granted.

Registry is directed to register the case as a regular acquittal appeal.

As Mr. S.C. Verma, accepts notice on behalf of the respondents, State is not required to pay separate PF. List this case along with Criminal Appeal No. 381 of 2017. State counsel is directed to supply copy of CRMP along with memo of acquittal appeal to Mr. S.C. Verma.
