This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.19/2015, registered at Police StationKhairagarh, District-Rajnandgaon (CG), for the offence punishable under Sections 379/34 and 75-B of the IPC.

I have heard learned counsel appearing for the parties and taking into consideration the facts & circumstances of the case, nature & gravity of the offence, the manner in which the trucks were said to have stolen by the applicant along with other co-accused persons, taking note of the fact that trial is on advance stage and only three witnesses are remained to be examined, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
