Contention of the petitioner is that her father died in harness on 28.02.2016 and immediately thereafter she made an application for grant of dependent appointment. However, till date no final decision has been taken

on her application.

Given the said facts, Shri Vaibhav Shukla, advocate present in the Court is directed to accept notice on behalf of all the respondents and the writ petition is disposed of with a direction to respondent no.3 and also to the concerned authority of the respondent organization to take a decision on the claim of the petitioner in accordance with the provisions of NCWA prevalent at that time and also keeping in view the recent decision of this Court in the case of Smt. Asha Pandey Vs. Coal India Limited and others decided on 15.03.2016 in WPS No. 4994 of 2015. Sd/- P. Sam Koshy Judge Bhola
