This revision is filed against the order dated 25.04.2017 passed by the learned Second Addl. Principal Judge, Family Court, Raipur (C.G) in Case No.584/2014 seeking enhancement of the interim maintenance from Rs.10,000/- to Rs.25,000/-.
Brief facts of the case are that the applicant wife filed a petition for maintenance. Initially the respondent did not choose to appear as such it proceeded exparte and an amount of Rs.12000/- was fixed for payment of interim maintenance. Subsequently the respondent filed an application to set aside the ex-parte order which was rejected.
Thereafter again an application was filed to set aside the ex-parte order wherein the court considering the facts and circumstances of the case by order dated 25.04.2017 directed the interim maintenance of Rs.10,000/- to be paid to the applicant. Hence this revision.
Perused the order dated 25.04.2017. It appears that still the parties are to adduce the evidence and the actual income is yet to be ascertained.
Since the instant revision is for enhancement of interim maintenance, at this stage, considering the quantum of maintenance fixed, I am not inclined to interfere in such order as the parties are yet to adduce the evidence and place on record the facts before the case can be decided on merits by the court below. In view of this, I do not find any illegality or perversity in the interim order. Accordingly, this revision is dismissed. However, the trial Court is requested to expedite the trial.
