Hon'ble Smt. Justice Rajani Dubey Order on Board 02.06.2021 • Proceeding through video conferencing.

• The applicant has filed this first bail application under Section 439 of the Code of Criminal Procedure for grant of regular bail in connection with Crime No. 262/2020 registered at Police Station : New Rajendra Nagar, District Raipur (C.G.) for the offence punishable under Section 18 (B) of NDPS Act.

• According to the prosecution story, on being informed, Police Personnel searched seized total 10.40 kg. illicit Opium and 34.400 kg Doda from the possession of the applicant. • Learned counsel appearing on behalf of the applicant would submit that the applicant is innocent and has been falsely implicated in the case. He would further submit that co-accused namely Kiran Chandani has been granted bail by this Court on 12.03.2021 passed in M.Cr.C. No. 9330/2020. The applicant is in

custody since 27.10.2020 and she is ready to furnish adequate surety and shall abide by all the conditions and directions imposed upon her, therefore, she may be released on bail. • Per contra, learned counsel appearing on behalf of the State opposes the bail application.

• I have heard learned Counsel for the parties. • Considering the facts and circumstances of the case, nature and gravity of the offence, as the trial is likely to take some time, without further commenting on merits of the case, I am inclined to release her on bail.

• Accordingly, the bail application is allowed. • It is directed that the applicant shall be released on bail on executing a personal bond for a sum of Rs. 50,000/- with one local surety for the like sum amount to the satisfaction of the trial Court for her appearance before the said Court as and when directed.
