The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.148/2016 registered in Police Station Ratanpur, District Bilaspur (C.G.) for offence punishable under sections 294, 506, 326 of Indian Penal Code and Section 25 of Arms Act. 2.

As per the prosecution case, on 16/06/2016 when a notice was being served to the applicant through agency of the Kotwar, the applicant went to the house of Bisahu Ram Tiwari caught hold of him and assaulted him by way of a sword. Thereby, offence is committed. 3.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, charge sheet has been filed, therefore no further investigation is necessary. He submits that on the previous enmity false allegations have been levelled, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary as also medical report. Considering the facts and circumstances, background of the case and also taking into fact that charge sheet has been filed, no further investigation is necessary, this

court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
