This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.168/2015, registered at Police StationKharora, District-Raipur (C.G.), for the offence punishable under Sections 376, 363 & 366 of the IPC and Section 4 of the POSCO Act. 2.

I have heard learned counsel appearing for the parties and taking into consideration the facts & circumstances of the case, nature & gravity of the offence, age of the prosecutrix, who is said to be minor on the date of commission of offence and the manner in which the applicant is said to have committed forceful sexual intercourse with her, this Court is of the opinion that present is not a fit case, in which, the applicant should be enlarged on regular bail. 3.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected. However, considering the fact that the trial is on advance stage, the trial Court is directed to expedite the trial and conclude the same as early as possible. Sd/- (Sanjay K. Agrawal) JUDGE B/-
