The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.136/2016 registered in Police Station Ratanpur, District Bilaspur (C.G.) for offence punishable under section 306 of IPC.

As per the prosecution case, the applicant was married to deceased Kaveri Bai on 3rd May, 2015. It is case of the prosecution that after consuming liquor, the applicant used to abuse and assault the deceased. Consequently, she committed suicide by pouring kerosene oil and set herself ablaze.

Learned counsel for the applicant submits that the applicant has not abetted for commission of crime and on the trivial issue wife has committed suicide. He submits that charge sheet has been filed, no further investigation is necessary, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the neighbours Joidha and Dwarika Prasad. Considering the statement and also for the fact that charge sheet

has been filed, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
