The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.193/2015 registered in Police Station Bagicha Dist. Jashpur (C.G.) for offence punishable under sections 419, 441, 468, 420, 114 of IPC read with section 6 & 10 of Chhattisgarh Examination Act.

As per the prosecution case, the applicant in his place allowed one Arjun Chauhan to appear in the examination which was conducted on 23/10/2015 at Government Higher Secondary School Mahadevdand. Thereby, offence is committed.

Learned counsel for the applicant submits that charge sheet has been filed, no further investigation is necessary. He submits that another co-accused has been enlarged on bail in M.Cr.C. No.7451 of 2015 on 6/01/2016, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Considering the facts and circumstances of the case and also for the fact that co-accused has been enlarged on bail in M.Cr.C. No.7451 of 2015 on 6/01/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
