The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 516/2015 registered in Police Station Gurur, District Balod(C.G.) for offence punishable under section 354, 354 (B) of IPC & Section 7-8 Protection of Children from Sexual Offences Act, 2012.

According to the prosecution story on 8/09/2015 at about 10.30 prosecutrix who was aged about 16 years resident of Dhanapuri was going to school, at that time applicant met her and caught hold of her hand and tried to drag her, but somehow the prosecutrix ran away and subsequently when she came back to her house reported the matter to the police station and case was registered.

Learned counsel for the applicant submits that applicant is in jail

since 9/09/2015 and charge sheet has been filed. He further submits that no further investigation is necessary, considering the nature of offence, applicant may be enlarged on bail.

Learned State counsel opposes the prayer for grant of bail. 5.

I have heard learned counsel for the parties. 6.

Having regard to the facts of this case and taking into account gravity and nature of offence and taking into fact that charge sheet has been filed and applicant is in jail since 9/09/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed. Certified copy as per rules.
