(2) This is the second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested on 02.08.2015 in connection with Crime No.613/2015 registered at Police Station Punjipathra, District Raigarh, for the offence punishable under Sections 34(1)(A)(2) of the Chhattisgarh Excise Act.

(3) The applicant's first bail application was dismissed as withdrawn with liberty to file the same after disposal of criminal case relating to the excise offence by order of this Court dated 01.09.2015 passed in

M.Cr.C. No.4442/2015.

(4) The second bail application has been filed without disposal of criminal case relating to the excise offence, as such, the second bail application cannot be entertained in view of the order dated 01.09.2015. Consequently, the second bail application of the applicant is rejected.
