1. The applicant has preferred the second bail application under Section 439 of Cr.P.C. as he is in jail since 7-5-2020 in connection with Crime No. 79 of 2019 registered in Police Station- Dhaupur, District Surguja (CG) for the offence punishable under Section 302 read with Section 34 of the IPC. Earlier bail application of the applicant was dismissed as withdrawn vide order dated 30-9-2020 passed by this court.

2. Learned counsel for the applicant also seeks permission of this court to withdraw the second bail application.

3. Permission is granted.

4. Accordingly, the instant bail application is dismissed as withdrawn.
